1. Agreement to Terms

By downloading, installing, or using the Dumbly app ("App"), you agree to these Terms of Use and End User License Agreement ("Terms"). If you do not agree, do not use the App. These Terms form a legally binding agreement between you and Dumbly ("we," "us," or "our").

2. End User License Agreement (EULA)

2.1 License Grant

Dumbly grants you a personal, limited, non-exclusive, non-transferable, revocable license to install and use the App on Apple-branded devices you own or control, solely for your personal, non-commercial fitness purposes.

2.2 License Restrictions

You may not:

• Copy, modify, adapt, translate, or create derivative works of the App
• Reverse-engineer, decompile, disassemble, or attempt to extract the source code
• Sell, sublicense, rent, lease, or transfer the App or your rights to any third party
• Remove or alter any proprietary notices, labels, or marks on the App
• Use the App to build a competing product or service

2.3 Apple as Third Party

You acknowledge that these Terms are between you and Dumbly only, not with Apple Inc. Apple is not responsible for the App or its content. Apple has no obligation to provide maintenance or support for the App. In the event of any failure to conform to applicable warranties, you may notify Apple and Apple will refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation.

2.4 Third Party Beneficiary

Apple and its subsidiaries are third-party beneficiaries of these Terms and have the right to enforce them against you.

3. Eligibility

You must be at least 13 years old to use Dumbly. If you are between 13 and 18, you must have parental or guardian consent. By using the App, you represent that you meet these requirements.

4. Account Registration

4.1 You may sign in using Apple Sign-In or Google Sign-In. You must provide accurate, complete information and keep it up to date.

4.2 You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

4.3 Notify us immediately at [email protected] if you suspect unauthorized access to your account.

4.4 Account Deletion

You may permanently delete your account at any time from Profile → Account → Delete Account. Deletion is irreversible and will permanently remove all your data from our servers, including workout history, progress data, and profile information.

5. Subscriptions & Billing

5.1 Subscription Plans

Dumbly offers the following auto-renewable subscription plans:

Prices may vary by country and are displayed in local currency at the time of purchase.

5.2 Billing

Payment is charged to your Apple ID account at confirmation of purchase. All billing is processed by Apple and governed by their payment terms.

5.3 Auto-Renewal

Subscriptions automatically renew at the end of each subscription period unless cancelled at least 24 hours before the renewal date. Your account will be charged for renewal within 24 hours prior to the end of the current period.

5.4 Free Trial

Where offered, a free trial period (e.g. 7 days) will automatically convert to a paid subscription at the end of the trial unless cancelled at least 24 hours before the trial ends. Any unused portion of a free trial is forfeited when you purchase a subscription during the trial period.

5.5 Cancellation

You can cancel your subscription at any time through your Apple ID Account Settings at Settings → [Your Name] → Subscriptions. Cancellation takes effect at the end of the current billing period. No refunds are provided for the unused portion of a subscription period.

5.6 Price Changes

We may change subscription prices with reasonable notice. Continued use after a price change constitutes acceptance of the new price.

6. Free Tier

Dumbly offers a free tier with access to the 30-Day Beginner Challenge. No payment is required for the free tier.

7. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose or in violation of any regulations
• Copy, modify, distribute, or exploit any content from the App without written permission
• Use bots, scrapers, or automated tools to access or extract content
• Attempt to gain unauthorized access to any part of the App or its systems
• Harass, abuse, or harm other users
• Misrepresent your identity or affiliation
• Interfere with or disrupt the integrity or performance of the App

8. Health & Fitness Disclaimer

8.1 The App provides fitness information for general wellness and educational purposes only. It is not a medical service and does not provide medical advice, diagnosis, or treatment.

8.2 Consult a qualified healthcare professional before beginning any exercise program, especially if you have a pre-existing medical condition, injury, or health concern.

8.3 Stop exercising immediately and seek medical attention if you experience pain, dizziness, shortness of breath, or any unusual symptoms.

8.4 You assume all risk associated with your use of the App and participation in any workout program.

9. Intellectual Property

All content within Dumbly — including workout programs, exercise videos, descriptions, the Dumbly mascot, AI coaching content, branding, design, and software — is owned by Dumbly and protected by copyright, trademark, and other applicable intellectual property laws. You receive no ownership rights by using the App.

10. Privacy

Your privacy is important to us. Please review our Privacy Policy, which is incorporated into these Terms by reference and describes how we collect, use, and share your information.

11. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DUMBLY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNTS YOU PAID TO DUMBLY IN THE 12 MONTHS PRECEDING THE CLAIM, OR $10 USD IF YOU HAVE NOT MADE ANY PAYMENTS.

13. Indemnification

You agree to indemnify and hold harmless Dumbly and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the App or violation of these Terms.

14. Termination

We may suspend or terminate your account and access to the App at any time, with or without notice, for violation of these Terms or for any other reason at our discretion. You may terminate your account at any time by deleting it from Profile → Account → Delete Account.

15. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes through the App or by email. Continued use of the App after changes constitutes acceptance of the revised Terms.

16. Governing Law & Disputes

These Terms are governed by the laws of British Columbia, Canada, without regard to conflict of law principles. Any disputes shall be resolved in the courts of British Columbia, Canada.
